Terms of Service

The Short Version

Umbra is a platform for underground artists to build their online presence. Use it to share your art, music, events, and links. Do not use it to break the law, harm others, or be a generally terrible human being. If you follow that, we will get along just fine.

Acceptance of Terms

By creating an account or using Umbra, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, do not use the platform. We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the updated terms.

Your Account

  • Eligibility — You must be at least 18 years old to use Umbra.
  • Account security — You are responsible for maintaining the security of your account credentials. Umbra is not liable for unauthorized access resulting from your failure to protect your login information.
  • One person, one account — You may not create multiple accounts to circumvent suspensions or bans. We reserve the right to merge or remove duplicate accounts.
  • Handle ownership — Your handle is yours as long as your account is active and in good standing. We reserve the right to reclaim handles that are inactive for an extended period, impersonate others, or violate trademarks.

Acceptable Use

You may use Umbra to promote your creative work, link to your platforms, share events, and connect with your audience. You agree not to:

  • Upload, post, or link to content that is illegal under applicable law, including but not limited to content that promotes or facilitates illegal drug sales, human trafficking, fraud, or exploitation of minors.
  • Post content that constitutes harassment, threats, doxxing, or targeted abuse of any individual or group.
  • Upload malware, phishing links, or deceptive content designed to steal credentials, install software, or redirect users to harmful destinations.
  • Use Umbra for spam, scams, or misleading commercial schemes including pyramid schemes, fake giveaways, or fraudulent fundraising.
  • Impersonate another person, artist, brand, or organization in a way that is intended to deceive.
  • Upload content that infringes on the intellectual property rights of others. Post your own work or content you have rights to share.
  • Attempt to exploit, attack, or reverse-engineer the platform, its infrastructure, or its APIs in any unauthorized manner.
  • Post child sexual abuse material (CSAM) or any content depicting the sexual exploitation of minors. This is a zero-tolerance policy and will result in immediate account termination and a report to the appropriate authorities.

Content and Ownership

  • Your content is yours — You retain full ownership of everything you upload to Umbra. We do not claim any intellectual property rights over your content.
  • License to display — By uploading content, you grant Umbra a limited, non-exclusive license to host, display, and distribute your content solely for the purpose of operating the service (e.g., rendering your profile page, generating link previews).
  • Removal — When you delete content or your account, we will remove it from our servers within a reasonable timeframe. Cached copies on third-party platforms (e.g., search engine caches) are outside our control.

Enforcement and Termination

  • We reserve the right to remove content, suspend, or permanently ban accounts that violate these terms, at our sole discretion.
  • For minor or first-time violations, we will generally issue a warning before taking action. Severe violations (illegal content, CSAM, fraud) may result in immediate termination without notice.
  • You may delete your account at any time. Upon deletion, all associated data, content, and your handle will be permanently removed.
  • If you believe a decision was made in error, you may contact us to appeal.

Availability and Liability

  • Umbra is provided “as is” without warranties of any kind, express or implied. We do not guarantee that the service will be available 100% of the time or free of errors.
  • We are not responsible for any loss of data, revenue, or opportunities resulting from service interruptions, bugs, or account actions taken under these terms.
  • Our total liability to you for any claims arising from your use of Umbra shall not exceed the amount you have paid us in the 12 months preceding the claim (which, given Umbra is free, means zero).

DMCA and Copyright Claims

If you believe content on Umbra infringes your copyright, please contact us at umbrasoft@proton.me with a description of the copyrighted work, the URL of the infringing content, and your contact information. We will review and respond in accordance with the DMCA.

Governing Law

These terms are governed by the laws of the State of California, United States. Any disputes arising from these terms or your use of Umbra shall be resolved in the courts of San Diego County, California.

Changes to These Terms

We may revise these terms as the platform evolves. Material changes will be communicated through the dashboard or via email. We will not retroactively apply terms that reduce your rights without notice.
